CORAM:
HON'BLE MR. JUSTICE R.K.GAUBA
O R D E R
% 18.04.2017 Crl. M.A. 6196/2017 (Exemption) Allowed subject to just exceptions.
BAIL APPLN. 668/2017 The learned sessions judge while rejecting the prayer for anticipatory bail of the applicant by order dated 04.02.2017 has taken note of the entire background facts and the law on the subject and therefore, the same does not call for repetition here. Suffice it to note that the applicant is the mother-in-law of the deceased person who was married on 28.01.2016. There is ample evidence available to indicate that the death was on account of poisoning coupled with external injuries caused by blunt course being applied.
BAIL APPLN. 668/2017
Having regard to the statement of Shashi Garg, mother of the deceased, recorded on 22.11.2016, the very next date after the death, it forming the basis of the FIR, it cannot be said that there are no allegations of cruelty for dowry or that the case is unfounded.. In view of the present stage of investigation, this can hardly be said to be a case for anticipatory bail to be granted. Dismissed.
