% 05.04.2016 IA 24434/2015(u/O VI R. 17 r/w Sec. 151 CPC) This is an application filed by the plaintiff seeking permission to amend the plaint. At the same time, I note that the suit which has been filed by the plaintiff is for specific performance and the valuation is Rs.20,00,330/-.

Keeping in view the position of law as laid down by the Division Bench of this Court, in case titled Mahesh Gupta vs. Ranjit Singh 159 (2009) DLT 624, this application needs to be decided by the Court concerned on transfer.

In view of Notification No. 27187/DHC/Orgl. dated 24th November, 2015 & in exercise of power conferred by Section 4 of

the Delhi High Court (Amendment) Act, 2015, (Act 23 of 2015), which came into force with effect from 26th October, 2015 vide Notification No. F.No.L-19015/04/2012-Jus dated 26th October, 2015 issued by the Government of India, Ministry of Law, Justice & Company Affairs published in Gazette of India Extraordinary, Part II, Section 3 Sub-Section (ii), the present matter is liable to be transferred to the learned District & Sessions Judge, District Central, Tis Hazari Courts, Delhi. Accordingly, the parties to appear before the learned District & Sessions Judge, District Central, Tis Hazari, Delhi on May 30, 2016.
