% 23.05.2017 The petitioner is seeking demolition of the ground, first and second floors of the property bearing No. A-1, Anand Vihar, Delhi-110092. Learned counsel for respondents No.2 and 3 submits that respondents No.2 and 3 have filed appeal No.311/2017 before the Appellate Tribunal MCD in which vide order dated 11th May, 2017, learned Appellate Tribunal has stayed the demolition of the first and second floors of the subject property. Copy of the order dated 11th May, 2017 is handed over and taken on record. Copy of the same is furnished to counsel for the petitioner in Court.

Learned counsel for the petitioner seeks permission to withdraw this writ petition with liberty to approach the Appellate Tribunal MCD to seek vacation of the stay.

The writ petition is dismissed as withdrawn with liberty as prayed for. J.R. MIDHA, J.
