% 19.09.2018 1.

Pursuant to the last date of hearing, learned counsel for the respondents states that she has obtained instructions from the respondent/CRPF to the effect that if the petitioner submits a fresh representation for posting him in a location, where he would be in a position to work within his physical capacity, they will consider it sympathetically.

2.

We may note that the petitioner has made several representations to the respondents and lastly on 29.05.2018 before filing of the present petition, which was rejected vide order dated 08.06.2018. Thus, we do not see any reason to direct the petitioner to make a fresh representation as his grievance had been detailed in the representation dated 29.05.2018 (page 168) itself. 3.

Learned counsel for the petitioner seeks to clarify that the request of the petitioner for posting him to a place where his treatment W.P.(C) 8120/2018

can continue need not necessarily be confined only to Delhi and Lucknow.

4.

The respondents are directed to reconsider the decision conveyed to the petitioner vide letter dated 08.06.2018, particularly in the light of the averments made in this petition and take a fresh decision, under written intimation to him. Needful shall be done within four weeks from today.

5.

If the grievance of the petitioner still survives, he shall be entitled to take legal recourse as permissible. 6.

The petition is disposed of alongwith pending application. HIMA KOHLI, J REKHA PALLI, J SEPTEMBER 19, 2018 sr W.P.(C) 8120/2018
