O R D E R

% 25.09.2018 The learned senior counsel, on instructions, submits that he may be permitted to withdraw the present bail application, the petitioner being content presently with the protection of advance notice of seven days, as granted by the court of sessions, vide its order dated 30.07.2018 on bail application no. 1013/18.

The learned counsel submitted that pursuant to the further directions in the said order of the court of Sessions, the petitioner had surrendered his passport with the investigating officer and was burdened with the restriction not to leave the country without permission of the court. He submitted that this condition is turning out to be harsh because the petitioner is an IT professional engaged by a multinational company and, pursuant to the nature of his duties, is obliged to go abroad on assignments. BAIL APPLN. 1838/2018

The bail application at hand before this court is dismissed as withdrawn vacating the interim orders passed herein. The petitioner has the liberty to move the court of sessions for modification of the conditions in the order dated 30.07.2018 with regard to the surrender of passport and restrictions against he leaving the country which application, when submitted, would undoubtedly be considered in the factual matrix of the case and in accordance with law.
