% 04.05.2017 On 16th September, 2016 this Court clarified that the criminal appeal in the present form was not maintainable and a leave to appeal had to be filed in terms of the decision of the Supreme Court reported as 2015 (10) Scale 444 Satyapal Singh Vs. State of M.P. & Ors. Despite repeated adjournments leave to appeal has not been filed till date.

Even on pass-over, none is present on behalf of the appellant. Appeal and application are dismissed for non-prosecution. MUKTA GUPTA, J.
