% 12.08.2016 Learned counsel for the petitioner submits that he seeks to withdraw the present petition with liberty to make his contentions regarding nonconsideration of the issue of limitation while passing the impugned order before the trial court.

Petition is dismissed as withdrawn with liberty granted as prayed for. All pending applications also stand disposed of accordingly. In case any such petition is filed before the trial court it may be considered in accordance with law uninfluenced by any observations made herein.
