% 15.10.2018 CM APPL. 30963/2018 Allowed, subject to all just exceptions.

W.P.(C) 8085/2018 Learned counsel for the petitioner had sought refund of Rs.4,06,007/- towards excess DVAT amounts. The respondents rely upon an order of 12.09.2018 which had granted Rs.3,99,840/- towards refund claim whilst setting off some amounts. The interest granted is Rs.5,189/-; the petitioner contested this figure and submits that interest has to be more. The respondents shall pass a speaking order on this aspect indicating as to why the interest for the balance period has been denied and the same shall be communicated directly to the

petitioner. In case of further grievance, it is open to the petitioner to seek recourse to the statutory remedies.

The writ petition is disposed of accordingly. S. RAVINDRA BHAT, J A. K. CHAWLA, J OCTOBER 15, 2018 nn
