% 10.08.2016 Crl.M.A. 12294/2016 Exemption allowed subject to just exceptions. CRL.M.C. 2869/2016 & Crl.M.A. 12293/2016 (stay) Aggrieved by the order dated 19th July, 2016 whereby while granting anticipatory bail to the petitioner in case FIR No.180/2015 under Sections 406/498A/34 IPC registered at PS Uttam Nagar, the learned Additional Sessions Judge imposed a condition of deposit of `2 lakhs in the form of FDR with the learned CMM (West) within three weeks, the petitioner prefers the present petition.

The petitioner has placed on record statement of account from his bank. It is apparent that the condition of deposit of `2 lakhs is onerous. Even as per the FIR the allegations of the complainant are that in the marriage approximately three lakhs were spent by her father who is also an auto-driver.

Learned counsel for the petitioner states that if the condition of `2 lakhs is modified to `1 lakh the petitioner will be able to deposit the same. Considering the facts and circumstances of the case maintaining the rest of the order dated 19th July, 2016 passed by the learned Additional Sessions Judge/ Special Judge (NDPS)(West) in the above noted FIR, the condition of deposit of sum of `2 lakh is modified to `1 lakh as undertaken by the learned counsel for the petitioner on instructions from the petitioner. The FDR in the sum of `1 lakh be deposited with the Court of learned CMM (West) within three weeks from today.
