% 02.11.2018 REVIEW PET. 398/2018 (by the petitioner for review of the order dated 02.08.2018) and CM APPL. 44938/2018 (delay) 1.

The present review petition has been filed by the petitioner praying the inter alia for reviewing the order 02.08.2018, whereby the writ petition was disposed of with an observation that the petitioner had not exhausted the equally efficacious alternate remedy of filing an appeal before the Appellate Authority against the order dated 10.03.2017, passed by the Disciplinary Authority.

Learned counsel for the petitioner states that on 02.08.2018, it was not pointed out to the Court that the petitioner had made several representations to the respondents, one of them dated 22.12.2017, which he states may be directed to be treated as an appeal and decided by the respondents in accordance with law.

Mr. Rajesh Kumar, learned counsel for the respondents, who appears on an advance notice, states that the petitioner has failed to reveal that his representation dated 22.12.2017, has already been decided by the Competent Authority vide order dated 20.01.2018 with a copy forwarded to him at his native place in district Haridwar, Uttarakhand. 4.

Pertinently, the affidavit filed by the petitioner alongwith the review petition bears the same address as has been mentioned by the respondents in their order dated 20.01.2018.

A copy of the aforesaid communication dated 20.01.2018 handed over by learned counsel for the respondents, is taken on record with a copy furnished to the counsel for the petitioner.

If the grievance of the petitioner still survives, he shall be entitled to seek legal recourse, as may be advised.
