% 12.02.2019 After some hearing, the learned counsel for the petitioner, on instructions, submits that he may be allowed to withdraw the present petition and the application filed therewith, the petitioner seeking liberty to raise the contentions set out in the petition as arguments to be raised qua the case before the trial court to be put on trial and, thereafter, if need be, during the trial.

The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed for granted. R.K.GAUBA, J.
