Petitioner impugns order dated 28.04.2018 whereby the review petition of the petitioner impugning order dated 15.02.2018 was dismissed.

By order dated 15.02.2018 the Rent Controller had noted that despite service petitioner had not filed any leave to defend application. Accordingly, eviction order was passed. 3.

Respondent had sought eviction of the petitioner from Shop in property bearing No.22-23/2744, Lane No.22, Beadon Pura, Karol Bagh, New Delhi, more particularly as shown in red colour in the site plan annexed to the eviction petition.

None appeared for the petitioner on 06.05.2019 and 14.05.2019 when notice of default was issued to counsel for the petitioner. Office report indicates that notice has not been served. RC.REV. 371/2018

Learned counsel for the respondent submits that in execution case No.33/2019 (CIS No.652/2019) petitioner has appeared before the Executing Court on 16.05.2019 and handed over the keys of the tenanted premises to the respondent as he could not pay the use and occupation charges fixed by this court by order dated 14.02.2019. 6.

None appears for the petitioner.
