O R D E R

% 09.09.2016 Mr. Kundu has tendered in Court the order dated 08.09.2016 passed on the petitioner's application seeking parole. In this case, the petitioner stands convicted under Sections 307/392/147/148/342 IPC. The maximum sentence awarded by the trial court was five years RI in relation to the offence under Section 307 IPC which has been reduced to two years by this Court in appeal. The nominal roll shows that the petitioner has undergone over 11 months of incarceration after conviction. The remaining sentence is 8 months and 8 days after counting remission earned as on 05.09.2016. This is the first application to seek parole made by the petitioner. He seeks parole to be able to file SLP before the Supreme Court.

Mr. Kundu submits that the petitioner is a bad character of the area. However, nothing has been placed on record in support of this submission. In any event, that may not be sufficient to deny parole to the petitioner to prefer the SLP and the petitioner can obviously be bound down to mend his conduct.

Accordingly, the petition is allowed. The petitioner is directed to be released on parole for a period of four weeks to enable him to file the SLP before the Supreme Court. The petitioner shall maintain good conduct during the period of parole and shall not indulge in any criminal activity during the said period. He shall mark his attendance at the concerned local police station on every Monday at 11 a.m. He shall also provide particulars of the Special Leave Petition filed by him at the time of his surrender. He shall surrender punctually at the end of the parole period. He shall be released from prison upon his furnishing personal bond with one surety in the like amount in the sum of Rs. 10,000/- to the satisfaction of Jail Superintendent. At the time of his release, he shall also provide his mobile number which shall be kept in working condition all the times and same shall not be changed.

The petition stands disposed of.
