O R D E R

% 16.08.2016 Present contempt petition has been filed alleging wilful disobedience of the order dated 23rd September, 2015 passed in W.P.(C) 288/2013 whereby respondent/DDA was directed to comply with the order dated 31st July, 2013 within a period of six weeks by virtue of which, DDA was directed to allot an MIG flat to the petitioner as recommended by its competent authority. The respondent/DDA's review petition was also disposed of with consent as the petitioner had undertaken not to sell the flat for five years from the date of allotment.

Learned counsel for petitioner states that despite the aforesaid order, respondents have not allotted an MIG flat to the petitioner till date.

Today learned counsel for the respondent/DDA who appears on advance notice states that the petitioner's name has been approved for

allotment of an MIG flat. She assures this Court that the petitioner's name shall be included in the next draw of lots which is scheduled to take place within two months. The statement made by learned counsel for the respondent/DDA is accepted by this Court and DDA is held bound by the same.

In the event, petitioner is not allotted an MIG flat within a period of twelve weeks, he is given liberty to seek revival of the contempt petition.

With the aforesaid directions, present contempt petition and the application stand disposed of.
