O R D E R

% 08.09.2016 Ms.Mathur states that the facts have been verified. She states that, on instructions, the medical condition of the petitioner cannot be disputed. The petitioner has preferred the present transfer petition to seek transfer of the case titled CBI v. R.C. Sabharwal in FIR/RC 74A/95/DLI ACB-I for the offences punishable under Section 13(1)(e) and 13(2) of the Prevention of Corruption Act pending in the court of Sh. Jatinder Kumar Mishra, the learned Special Judge, PC Act, Karkardooma Courts to Saket Sessions Division or Patiala House Sessions Division on the ground that the petitioner is 72 years of age and he is suffering from ailments.

The petitioner is residing at New Friends Colony and to travel on each date of hearing to Karkardooma Courts where the case is presently pending puts undue strain on his health.

In the peculiar facts and circumstances of this case, as explained by the petitioner, I am inclined to allow the present petition. Accordingly, the aforesaid case stands transferred to Saket Sessions Division. The case shall be assigned to the concerned Special Judge by the learned District Judge. Petition stands disposed of.
