IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(C) 8382/2018 AMJAD ALI ..... Petitioner Through None versus SOUTH DELHI CORPORATION OF DELHI AND ORS.

..... Respondent Through Mr.Tushar Sannu, Standing Counsel, SDMC, Mr.Naveen Single, Ms.Ankita Bhadouriya, Advs. for SDMC

CORAM:

HON'BLE MR. JUSTICE JAYANT NATH

O R D E R

% 17.02.2020 Status Report has been filed by SDMC in court which is taken on record. It is pointed out in the status report that despite orders of this court the demolition action could not be executed due to non-availability of police force. A letter was received from the concerned DCP, South East District, by which it was stated that all proposed demolition and sealing programmes in South East District for the month of January and February 2020 be postponed upto 29.02.2020. A copy of the letter written by the Additional Deputy Commissioner of Police, South East District is attached. This communication is prima facie in blatant violation of the order of this court dated 14.1.2020.

However, keeping in view the reasons given in the communication as to why police force was not provided, I do not propose to take penal action against the concerned officer.

It is manifest that the respondents are taking steps as per law. They will deal with this property accordingly. On the next proposed date for demolition necessary police protection shall be provided by the concerned police station.

Nothing further survives in the present petition. Petition stands disposed of. All pending applications, if any, also stand disposed of. JAYANT NATH, J FEBRUARY 17, 2020 n
