% 13.08.2018 Notice. Learned APP accepts notice for respondent no.1. Respondent no.2 is also present in Court along with her counsel, who accepts notice. She has been identified by SI Dharmender Kumar of police station Mandir Marg.

Respondent no.2 submits that she has settled the matter with petitioner no.1 of her own free will and without any undue force, pressure or coercion before the Counselling Cell, Family Court, Patiala House Court, New Delhi on 31st January, 2018. She further submits that first motion for divorce by mutual consent under Section 13-B(1) of the Hindu Marriage Act, 1955 has already been accepted by the Family Court, inasmuch as,

second motion has also been filed and is listed for today. Respondent no.2 submits that she has no objection in case FIR No. 11/2017 under Sections 498A/406/34 IPC registered at police station Mandir Marg is quashed against the petitioner no.1 and his relatives, that is, petitioner nos. 2 to 6. Keeping in mind the settlement arrived at between the petitioner no.1 and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, aforesaid FIR and the consequent proceedings emanating therefrom are quashed, subject to acceptance of second motion by the Family Court. Petition is disposed of in the above terms.
