O R D E R

% 02.03.2016 CM Appl. No. 6792/2016 This application has been jointly moved by the petitioner and respondent No. 1 praying that the matter be disposed off in terms of the compromise entered into between the parties on 12th February, 2016. This application is signed by the petitioner as well as respondent No. 1. Affidavits of the petitioner and respondent No.1 are also annexed to this application. A copy of the compromise deed dated 12th February, 2016 is also annexed to this application. In terms of the settlement, respondent No. 1 has agreed to pay a total amount of Rs.9,00,000/- to the petitioner, in three equal W.P.(C) 4271/2015

instalments in full and final settlement of all the claims of the petitioner. It is stated that out of the said amount, a sum of Rs.6,00,000/-, against two of the instalments as contemplated in the settlement, have been paid by respondent No. 1 after deducting TDS payable thereof. In addition, the necessary Experience Certificate as envisaged in the Clause 'd' of the settlement has been handed over to counsel for the petitioner in the Court today. The third and final instalment of Rs.3,00,000/- has been handed over to counsel for the petitioner in the Court today by way of a demand draft. The petitioner, who is present in person, also approbates the aforesaid settlement and states that with the receipt of this amount, he has no further claims against respondent No.

1 and prays that this petition be disposed off in terms of the aforesaid compromise. He also states that as envisaged in the settlement, he shall have no objection to the withdrawal of the other Writ Petition No. 187/2016. Counsel for respondent No. 1 also states that the said petition, which is listed before another Bench of this Court today, shall be duly withdrawn.

It is ordered accordingly.

Under the circumstances, the present writ petition and all pending applications are disposed off in terms of the aforesaid settlement. All interim orders stand vacated. The petition is disposed off accordingly.
