1. This is an application filed by the Plaintiffs seeking withdrawal of the suit.

2. Notice. Mr. Naveen Kumar Chaudhary, learned counsel accepts notice on behalf of the main contesting Defendant Nos. 3 and 4 and states that the present suit was consolidated with CS (OS) No. 1950 of 2013 by this Court by its order dated 29th October 2014 and the evidence in CS (OS) No. 1950 of 2013 shall be read in the present suit. However, they have no objection to the withdrawal of the present suit.

3. In that view of the matter, this application is allowed.

CS (OS) No. 2562 of 2013

4. The suit is dismissed as withdrawn. However, it will be open to the parties in CS (OS) No. 1950 of 2013 to rely on the documents of the present suit.

5. The next date fixed in the present suit before the Joint Registrar, i.e., 18th October 2016 stands cancelled.
