% 11.08.2016 Crl.M.A. 12435/2016 Exemption allowed, subject to all just exceptions. WP(Crl.) No.2366/2016 By the present petition, the petitioner seeks quashing of FIR No.565/2016 under Sections 366/376 IPC registered at PS Aman Vihar on the ground that parties have settled the matter. In view of the decision of Supreme Court in the case reported as 2012(9) Scale 257: 2012 (10) SCC 303 Gian Singh Vs. State of Punjab & Anr. since the offence punishable under Section 376 IPC is a serious offence, the same cannot be quashed on the ground that parties have settled the matter.

Faced with this situation, learned counsel for the petitioner seeks leave to withdraw the petition.

Petition is dismissed as withdrawn.
