After negotiations the matter has been settled between the appellant and respondent No.1. Though, the compensation so awarded in this matter is ₹4,94,280/- along with interest @ 12% per annum with effect from 23.09.2002 and an appeal has been filed by the appellant which was admitted vide order dated 17.08.2016 and later on vide other orders, the appellant was directed to deposit the entire amount of compensation. 2.

The said amount could not be deposited, but it was agreed that on payment of `3,00,000/- as lump sum to respondent No.1, the appeal shall stands disposed of.

It is submitted by the appellant that he has already deposited an FAO 395/2016

amount of `2,47,000/- before the Labour Commissioner which may be released to the respondent No.1 and that appellant would further pay or deposit of an amount of `53,000/- on or before 20.04.2017 to the respondent No.1, lest interest at the rate of 9% per annum shall be charged on this amount w.e.f. 08.04.2017 till the date of realisation. 4.

Subject to payment of aforesaid amount, the appeal and pending application shall be disposed of.
