BAIL APPLN. 1639/2016 and BAIL APPLN. 1640/2016 By the present petitions the petitioners seek anticipatory bail in case FIR No. 468/2016 under Sections 323/341/506/509/34 IPC registered at PS Lajpat Nagar.
Learned counsel for the petitioner contends that the petitioners are mother and daughter. Allegations have been levelled by the complainant against all the family members of the petitioners. Though the allegations are of beating with hockey, rod, bricks etc. but the only injury on the person of the complainant is scratch marks over the chest. There is no chance of the petitioners fleeing away from the justice and they will join the investigation as and when they are required. Even , as per the case of the complainant, the quarrel arose on a petty issue on use of unparliamentary language. Learned APP for the State has handed-over the status report and taken me through the contents of the FIR. He has also brought to the notice of this Court the MLC of the complainant.
th The allegations of the complainant in the FIR are that on 15 July, 2016 at about 9.30 AM while she was cleaning her cooler her neighbour Aman, Ankush, Shweta and Asha came and started abusing her. They also assaulted her with hockey, rod, bricks etc. When her mother-in-law came to her help, they assaulted the mother-in-law also. Allegations of misbehaviour are also attributed to Aman and Ankush. The complainant alleged that she somehow managed to enter inside the house and called the Police.
Though the allegations of the complainant are that she was assaulted with hockey, rod, bricks etc., however no such injuries were found on her BAIL APPLN. 1639/2016 BAIL APPLN. 1640/2016
body when her MLC was prepared on 15^*^ July, 2016 at 12.15 noon. As per the MLC the only injuries noted were scratch marks on the chest. No MLC of the mother-in-law of Anju was also prepared as there was no injury on her body.
Considering the facts and circumstances of the case and the fact that petitioners are mother and daughter respectively and the quarrel started all of a sudden, I deem it fit to grant anticipatory bail to the petitioners. It is therefore directed that in the event of arrest petitioners be released on bail on their furnishing a personal bond in the sum of ?20,000/- each with one surety each of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that they will join the investigation as and when directed and will not leave the country without prior permission of the Court concerned.
Petitions are disposed of. Order dasti.
