IN THE HIGH COURT OF DELHI AT NEW DELHI
+ CRL.M.C. 4248/2018 SURENDER AND ANR.
..... Petitioners Through:
Mr.
N.
Ojha and Ms.
Suman Chauhan, Advs.
versus STATE AND ORS.
..... Respondents Through Ms. Manjit Arya, APP for State with ASI Ashwani, P.S. Mehrauli.
Respondent nos. 2 and 3 in person.
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 05.10.2018 Respondent nos.2 and 3 are present in Court and have been identified by ASI Ashwani of police station Mehrauli.
They submit that they have settled the matter with petitioners of their own free will and without any undue force, pressure or coercion vide Compromise Deed dated 12/10/2015. They submit that petitioners are known to them and quarrel took place on trivial issue wherein they had received simple injuries. They say that they have no objection in case FIR No. 2610/2015 under Sections 308/323/34 IPC registered at police station Mehrauli is quashed. Affidavits of respondent nos.2 and 3 in this regard are also on record. Keeping in mind the settlement arrived at between the petitioners and
respondent nos.2 and 3 voluntarily, in my view, no fruitful purpose would be served in keeping the FIR pending.
Accordingly, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
