FAO 431/2016 & C.M.No.32438/2016 On the last date, some proxy counsel had appeared and had chosen to argue for some time and when he could not satisfy this Court as to why this appeal should be entertained, he had sought adjournment on the ground that the main counsel is not available. In the interest of justice, adverse orders were deferred and this appeal was adjourned for today. None appears today on behalf of appellant even on the second call. In such a situation, it is deemed appropriate to dismiss this appeal as well as the application in default.

This appeal and the application are accordingly dismissed in default.
