% 07.03.2018 This petition seeks enforcement of Arbitral Award dated 26.10.2015 passed by the Sole Arbitrator in the arbitration proceedings between the parties.

It is not denied by the counsel for the Decree Holder that the invocation of the arbitration had taken place prior to the coming into force of the Arbitration and Conciliation (Amendment) Act, 2015. Counsel for the Judgment Debtor submits that the Judgment Debtor has challenged the Arbitral Award by way of a petition under Section 34 of the Arbitration and Conciliation Act, 1996 being ARB P. No. 8724/2017 and the same is pending adjudication before the Additional District Judge, Patiala House Courts, New Delhi.

In view of the judgment of this Court in Ardee Infrastructure Pvt. Ltd. v. Ms. Anuradha Bhatia, (2017) 237 DLT 140 (DB), the present
