The petitioner impugns order dated 24.07.2018 whereby the application of the petitioner for recall of process initiated under Section 82 Cr. P.C. has been dismissed on the ground that the petitioner did not appear in person.

Learned counsel for the petitioner seeks leave to withdraw the petition with liberty to approach the trial court afresh for recall of process initiated under Section 82 Cr. P.C. by appearing in person. 3.

In view of the above, the petition is dismissed as withdrawn. The petitioner is given liberty to approach the trial court for recall of CRL.M.C. 3952/2018

process under Section 82 Cr. P.C., however, petitioner shall be personally present in Court. The trial court shall consider the application in accordance with law.
