O R D E R

% 12.04.2017 Counsel representing the petitioners, on instructions, submits that the matter has been amicably resolved, in terms of which parties have agreed, inter alia, to proceed for divorce by a mutual consent in the wake of which, the first motion has taken place before the Family Courts on 10th April, 2017 and that the second motion will take place after the interval of six months. He submits that in terms of the settlement, both the parties are to approach this Court by way of appropriate petition for quashing of the criminal case. He submits that though primarily, it is the obligation of the respondent No.2 to take steps but the petitioners and the said respondents would be initiating the necessary proceedings in due course.

In view of these circumstances, this petition is presently withdrawn. Liberty is sought to move afresh in case respondent No.2 fails to cooperate or abide by the settlement.

The petition is dismissed as withdrawn with liberty, as prayed for. R.K.GAUBA, J APRIL 12, 2017/neelam
