O R D E R

% 12.09.2018 The present petition under Article 226 of the Constitution of India, prays as follows:- "a) Issue a Writ of Mandamus and/or any other Writ of appropriate nature thereby directing the Respondent to perform its statutory duties under Section 277 to 279 of the New Delhi Municipal Council Act, (as applicable) and thereby the Respondent be directed to inspect the property being B Block, Servant Quarters and other constructed properties of similar nature, to assess its structural safety and take further action, in accordance with law, and more specifically in terms of Section 277 to 279 of the New Delhi Municipal Council Act, 1994, if so required, as per law;

b) Pass any other order which the Hon'ble Court deems fit and proper under the peculiar facts and circumstances of the present case."

After some arguments, learned counsel appearing on behalf of the petitioner, limits the relief in the present petition, to a direction to the Chairperson of the New Delhi Municipal Council (NDMC), to act on the information furnished by them, in relation to the properties in B-Block, Servant Quarters, Sujan Singh Park, New Delhi-110003. Issue notice.

Mr. Tushar Sannu, learned Additional Standing Counsel accepts notice on behalf of the New Delhi Municipal Council and states that, necessary action shall be taken by the Chairperson, NDMC, strictly in accordance with law, in respect of the information furnished on behalf of the petitioner, as elaborated, in the present proceedings. No further directions are called for in the present petition. With the above directions, the writ petition is disposed of. Pending application also stands disposed of.

Copy of the order be given dasti under the signature of the Court Master to learned counsel for the parties.
