Learned APP accepts notice for respondent no. 1.
Respondent nos. 2 and 3 are present in Court along with their counsel and accept notice.
They have been identified by SI Manish Tyagi of police station Gandhi Nagar.
It is submitted that petitioner and respondent nos.2 and 3 are neighbours. A quarrel took place between them, which led to registration of the FIR No.510/2017 under Sections 326(A)/308 IPC registered at police station Gandhi Nagar on the complaint of respondent no. 2. With the interventions of common friends and other family members, petitioner and
respondent nos. 2 and 3 have settled their disputes amicably, vide a Compromise/Settlement Deed dated 25th July, 2018; therefore, aforesaid FIR and consequent proceedings emanating therefrom may be quashed.
Respondent nos. 2 and 3 admit having settled the matter with petitioner of their own free will, voluntarily and without any undue force, pressure or coercion and they have no objection in case aforesaid FIR and consequent proceedings emanating therefrom are quashed against the petitioner. During the course of hearing, it has been pointed out that trial court has framed the charge under Section 308 IPC against the petitioner. Keeping in mind the settlement arrived at between the petitioner and respondent nos. 2 and 3, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.
Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
