% 17.08.2016 Present Writ Petition has been filed seeking a direction to the respondents to allot site no.15(A) to (D) and 20 (C) to 20 (D) near Metro Station Pitam Pura, opposite Max Hospital Delhi for holding Ganesh Utsav for a period from 22nd August, 2016 to 20th September, 2016.
Learned counsel for the petitioner states that the Division Bench of this Court vide its order dated 5th August, 2016 in W.P.(C) No.11911/2015 has clarified that the pendency of the said writ petition with regard to the subject tender would not come in the way of the respondent/DDA in deciding petitioner's application for allotment of land for the purpose of holding religious functions. Learned counsel for the petitioner also states that the petitioner has made a representation dated 6th August, 2016 for allotment of land but no reply has been received till date.
Keeping in view the limited relief sought by the petitioner, present writ petition is disposed of with a direction to respondent no.2 to decide the petitioner's representation within a period of one week in accordance with law. This Court clarifies that it has not expressed any opinion on the merits of the controversy. The rights and contentions of all the parties are left open.
