% 04.10.2018 The counsel for the respondent submits that on account of some domestic issues, the respondent could not move an application withdrawing the complaint in terms of the settlement. On instructions, he gives a solemn undertaking that appropriate application will be moved withdrawing the complaint without any further delay or default within a week hereof, this without any insistence on the presence of the petitioner, who is accused in the case. The respondent is bound by the undertaking given on her behalf. The counsel for the petitioner, in this view, submits that he does not press for any relief or direction at this stage and may be permitted to withdraw the present petition and the application filed therewith, though reserving the right to approach the court again in the event of any further default.
The petition and the application filed therewith are disposed off accordingly.
