Counsel for the parties have been heard at length. 2.

During the course of hearing it is agreed that this appeal be disposed of by a consent order that the rate of rent will be taken at Rs.80/- per month and the entitlement of the appellant/plaintiff to claim rent would be at Rs.80/- per month for three years prior to filing of the suit on 2.1.1993.

Accordingly, there will be a money decree passed in favour of the appellant/plaintiff and against the respondent No.1/defendant No. 1 for a sum of Rs.2,880/-.

In case the defendants/respondents have deposited any amount in the trial court, and which was done without prejudice to the respective rights, amount deposited to the extent of money decree passed today be released in favour of the appellant/plaintiff. If there is any amount deposited in excess of Rs.2,880/- the same will be released back to respondent No.1/defendant No.1 by the trial court. 5.

The appeal is accordingly disposed of in terms of the aforesaid consent order.

Parties are left to bear their own costs.
