Learned counsel for the appellants has handed over to the respondent through his counsel a pay order bearing No.076488 in the sum of Rs.5 lacs drawn on HDFC Bank, Safdarjung Branch, New Delhi and this amount of Rs.5 lacs is received by the respondent in full and final satisfaction of all the claims of the respondent against the appellants.

On receipt of this amount each and every dispute which is subject matter of the present litigation will stand settled and satisfied.

The amount received by the respondent is given by the appellants to the respondent as ex gratia payment not for any issue of

defamation but in respect of mental agony and suffering all which respondent/plaintiff had undergone.

The appeal along with all pending applications is accordingly disposed of in terms of the aforesaid consent order. 4.
