This is a petition under Section 27 of the Arbitration and Conciliation Act, 1996 (hereafter the Act), inter alia, praying for assistance of this Court in taking evidence.

The learned counsel for the Petitioner has drawn the attention of this Court to an order dated 28.03.2016 passed by the Arbitrator permitting the Petitioner to approach this Court. The Petitioner has sought the assistance of this Court to summon four witnesses. The question whether the evidence of the said witnesses are necessary has not been examined by the Arbitrator.

Accordingly, the instant petition is disposed of with the liberty to the Petitioner to approach the Arbitrator, who would examine whether the witnesses sought to be summoned are necessary for proceeding in the matter. If so, the Arbitrator will pass an appropriate order and the Petitioner is at liberty to approach this Court thereafter.

The Petitioner is also at liberty to take a soft copy of the records of Arbitration Petition No.330/2012 and produce the same before the Arbitrator.
