% 02.11.2016 The status report in terms of the last direction has not been placed on record. Counsel for the petitioner submits that the status report is ready. Her instructions are that this petition relates to two properties i.e. property no. C-14 and property bearing no. C-15, Freedom Fighters Colony, Neb Sarai, New Delhi. Counsel for the respondent under instructions submits that qua property C-14, property already stands booked on 20.07.2015. This property comprises of ground floor and first floor and infact it has been raised up to fourth floor. Demolition order qua this property has also been passed. Sealing action has been initiated under section 345A of the DMC Act vide orders dated 19.01.2015 and 18.04.2016. Copies of the said orders have been placed on record. Prosecution action under section 466-A of the DMC Act has also been initiated. Letter for disconnection of electricity and water
supply has been sent to the concerned authorities. Demolition action has been fixed on various dates and lastly on 13.11.2015 but the action could not be taken due to non-availability of the police force. Sealing of the property however been effected on 19.01.2016. Seal was thereafter found tempered with. FIR proceedings have also been initiated against the alleged culprit.
Qua property bearing no. C-15 it is pointed out that this property comprises of ground floor and has been raised up to third floor. Demolition order has been passed qua this property. Sealing action has also been initiated. Prosecution action under section 466-A of the DMC Act was also carried out. FIR has also been registered i.e. FIR bearing no. 3343/2015. Letter for disconnection of electricity and water was issued the concerned authorities on 01.12.2015. Demolition action was initiated on 15.01.2016 and portion of the first floor was demolished. The floor was also sealed on 18.04.016. Seal tempering had been noted. File has been moved for lodging appropriate FIR. Demolition action has now been fixed for both properties on 02.11.2016. Counsel for respondent submits that all necessary action in accordance with law shall be undertaken and completed. This undertaking of respondent is taken on record. Petitioner is satisfied with this order and has not pressed this petition. No further orders are called for in this petition. Petition disposed of.
