This is the second anticipatory bail application of the petitioner in case FIR No.161/2016 under Sections 376/354C/506 IPC registered at PS Khayala.

The change in the circumstance as per the learned counsel for the petitioner is that the petitioner and the complainant have settled the matter and have decided to marry.

The offence under Section 376 IPC is a serious offence and merely because the parties have settled the matter the same would not be a change BAIL APPLN. 1652/2016
of circumstance permitting this Court to entertain the second bail application.

Learned APP for the State also informs that the petitioner has already been declared a proclaimed offender on 25th July, 2016. 5.
Considering the facts and circumstances of the case, I do not find it to be a fit case to grant anticipatory bail.

Bail application is dismissed.
