The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.989/2015 registered under Sections 302/201 IPC at PS Mahendra Park. Status report is on record.

I have heard the learned counsel for the parties and have examined the file. Petitioner's counsel urged that the petitioner is in custody since 05.11.2015. The charge has yet not been framed. There is no worthwhile evidence on record to connect the petitioner with the crime.

Status report reveals that the victim / deceased was petitioner's uncle. The petitioner along with his associate used to often visit the victim.
Quarrels had taken place between the two on several occasions. Status report further reveals that pursuant to the disclosure BAIL APPLN. 1682/2016
statement crime weapon i.e. Gandasa has been recovered from the victim's room. DNA profiling of the blood found on the weapon of offence found has matched with DNA profiling of the blood of the deceased.
Co-accused Shankar @ Bengali @ Arjun is absconding. Statements of the material witnesses are yet to be recorded. 4.
Considering the gravity of the offence, no sufficient ground for grant of bail to the petitioner at this stage. The bail application is dismissed.
