W.P.(C) 3938/2015 & CM 7037/2015 Mr Ganesh, the learned senior counsel appearing on behalf of the petitioner, states, on instructions, that he may be permitted to withdraw this writ petition inasmuch as he would be filing an appeal against the impugned assessment order. He also states that he shall be filing an application for stay before the Assessing Officer.

He submits that both the appeal and the stay application would be moved within a week from today. He requests that till his stay application is disposed of by the Assessing Officer, no coercive measures be taken.

The writ petition is dismissed as withdrawn with the aforesaid liberty. We make it clear that the Assessing Officer shall dispose of the stay application, if filed within a week, in accordance with law.
