HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 26.09.2018 By this petition, the petitioner seeks parole on the ground that he has to file SLP before the Hon'ble Supreme Court and to re-establish social ties and also challenges the communication dated 29th June, 2018 whereby the application for grant of parole on the ground noted above was rejected. On a notice being issued a status report has been handed over which is taken on record. As per the status report the family of the petitioner comprising of his parents and two younger brothers was found residing at H. No. 3206, 1st Floor, Gali Pahadi Wali, Phatak Teliyan, Turkman Gate, Delhi. Nominal roll of the petitioner shows that the petitioner has been now in continuous custody for more than six years without any interim bail W.P.(CRL) 2427/2018

or suspension of sentence. The petitioner is not involved in any other offence.

Considering the incarceration of the petitioner coupled with the fact that the petitioner has roots in the society, this Court deems it fit to grant parole to the petitioner.

It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount, which surety would be a family member of the petitioner, subject to the satisfaction of the learned Trial Court, further subject to the condition that the surety of the petitioner would give the mobile number which would be kept in active mode so that the petitioner can be contacted during the period of parole, if required.

Petition is disposed of.

Copy of this order be communicated to the petitioner through Superintendent, Tihar Jail.

MUKTA GUPTA, J.
