O R D E R

% 18.11.2016 The status report has been tendered in Court and taken on record. The petitioner has preferred the present bail application under Section 438 Cr.P.C. apprehending arrest in case FIR No.252/2016 under Section 33/38 of the Delhi Excise Act registered at PS - Mundka. The submission of the petitioner is that he has been involved in a case only on account of the fact that he is registered owner of the vehicle in which the illicit liquor was allegedly found. He, however, submits that the petitioner has already sold the vehicle through an agent about two years ago but the ownership of the same was not got transferred by the purchaser.

Learned counsel submits that in terms of the order dated 01.09.2016, the petitioner has already joined the investigation. The status report also substantiates this position.

Since the petitioner has already joined the investigation, in my view, no useful purpose would be served in taking him into custody. Accordingly, in case of his arrest, the petitioner shall be released on bail upon his furnishing personal bond with one surety of Rs.10,000/- to the satisfaction of the arresting officer, subject to the condition that the petitioner shall continue to join the investigation as and when called for and cooperate therewith. He shall also not contact any of the prosecution witnesses or tamper with the evidence in the case.
