CORAM:

HON'BLE MR. JUSTICE RAJIV SHAKDHER

O R D E R

% 06.08.2018 I.A. No. 10393/2018 (Exemption) 1.

Allowed, subject to just exceptions.

O.M.P.(MISC.)(COMM.) 180/2018 2.

Issue notice.

3.

Mr. M.U. Khan accepts notice on behalf of the respondent. 4.

Learned counsel says that he does not wish to file a reply and does not oppose the prayer made in the petition for extension of time. 5.

The record shows that the arbitral tribunal entered upon reference on 21.01.2017. It appears that thereafter once initial 12 months expired, by mutual consent, parties extended the time frame within which the arbitral tribunal could render an award. Accordingly, time was extended till 20.08.2018.

O.M.P.(MISC.)(COMM.) 180/2018

6.

I am informed by counsel for the parties that the matter is still at the stage of arguments.

7.

Learned counsel for the parties also say that the record is voluminous and since, counter claims have also been filed, time be extended by one year.

8.

According to me, given the fact that the matter is at the stage of arguments, extension of time by 9 months should suffice. 9.

Resultantly, the time for pronouncement and publication of the award is extended by a further period of 9 months which will commence from 20.08.2018.

10.

The petition is disposed of in the aforesaid terms. RAJIV SHAKDHER, J AUGUST 06, 2018 c O.M.P.(MISC.)(COMM.) 180/2018
