O R D E R

% 11.11.2016 The petitioner has preferred the present bail application under Section 439 Cr PC. The petitioner is an accused in case FIR 569/2014 under Section 420/467/468/471/34 IPC. The petitioner is in judicial custody since 22.01.2016. The investigation is complete and the charge sheet stands filed.

The submission of learned counsel for the petitioner is that the petitioner has cooperated with the investigation and has provided all the materials and documents required. He submits that the continued detention of the petitioner in custody is of no avail since the charge sheet already stands filed.

On the other hand, the learned APP points out that the petitioner is

accused to have entered into an agreement to sell with the complainant on the basis of forged and fabricated documents. It is pointed out that even the document, namely, agreement to sell on the basis of which the petitioner claims title does not appear to be genuine. Learned counsel for the petitioner has voluntarily offered that to show his bonafide, he is willing to deposit before the Trial Court an amount of Rs.3 lacs.

Considering the fact that the petitioner has come forward to show his bonafide and the fact that the charge sheet stands filed, I am inclined to allow the present petition. Accordingly, the petitioner is directed to be released on bail upon furnishing his personal bond with one surety in the sum of Rs.20,000/- to the satisfaction of the Trial Court and subject to the condition that he deposits the amount of Rs.3 lacs before the Trial Court simultaneously at the time of release. The said amount shall be placed in a fixed deposit by the Trial Court and its disbursement shall be governed by the orders passed in that respect by the competent court. The petitioner shall, at the time of his release, provide his mobile phone number and keep the same on working condition at all times and shall not change the same without prior intimation to the court. He shall not contact or try to influence the prosecution witnesses in any manner. The application stands disposed of.
