% 20.11.2017 CA No. 1830/2017 (seeking leave to withdraw the present petition) Learned counsel for the petitioner and the respondent submit that the matter has been compromised between them and that the petitioner seeks to withdraw the present winding up petition.

This court had on 09.12.2014 appointed the Official Liquidator as the Provisional Liquidator of the respondent Company. The OL has spent Rs.18,25,287/- on account of expenses on various accounts. Learned counsel for the respondent submits that they would make the necessary payment within three weeks from today. In view of the above, the application is allowed. CO.PET. 675/2013 The petition is permitted to be dismissed as withdrawn.

The order dated 09.12.2014 is recalled subject to the respondent making necessary payment as noted above within three weeks from today. Petition is dismissed as withdrawn.
