IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(C) 9038/2018 OM PRAKASH AND ORS.

..... Petitioners Through Mr Ankur Goel, Advocate.

versus CENTRAL DISTRICT LEGAL SERVICE AUTHORITY ..... Respondent Through Mr Sarfaraz Khan, Advocate for DSLSA.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 31.10.2018 1.

The petitioner has filed the present petition, inter alia, impugning a communication dated 16.04.2018 whereby the Central District Legal Services Authority (DLSA) has held that since the offence was not committed within the jurisdiction of Delhi, it was not competent to award any compensation to the petitioners. Accordingly, the file was closed. 2.

Pursuant to the orders passed by this Court on 10.09.2018, the DLSA had filed an application before the Tribunal (MACT). MACT has once again examined the issue of jurisdiction and has passed an order dated 10.10.2018. 3.

In view of the above, this court considers it apposite to direct that the impugned order be treated as withdrawn. The DLSA shall examine the issue as to the jurisdiction and decide afresh.

4.

It is clarified that this Court has not expressed any opinion as to the correctness of the order passed by MACT. This order is passed as this Court

is of the opinion that the DLSA ought to re-examine the issue afresh in the light of the order dated 10.09.2018 and take an informed decision. The learned counsel for DLSA also concurs with the same. 5.

It is clarified that all rights and contentions of the parties are reserved. VIBHU BAKHRU, J OCTOBER 31, 2018 pkv
