W.P.(CRL) 2408/2016 Issue notice. Ms. Rao accepts notice. She has tendered in court the status report, which is taken on record. The illness of the petitioner's wife, who has undergone knee replacement surgery on 19.05.2016 has been verified. It is stated that she cannot walk properly and is using a stick for her movement. Her medical record shows that there is requirement of regular care for speedy recovery from injuries.

The petitioner's address has also been verified. She submits that the fact that the petitioner's 29 year old son who is mentally challenged has also been verified.

Learned counsel for the petitioner submits that the petitioner may be granted parole for a period of two weeks in view of the aforesaid difficult circumstances as the wife is not able to look after the mentally challenged son of the petitioner in her present state.

In view of the aforesaid position, though the petitioner was lastly released on parole w.e.f. 19.04.2016 to 18.05.2016, which had been extended till 14.06.2016, the petitioner is directed to be released on parole for a period of two weeks. His jail conduct has been found to be satisfactory, and out of the sentence of 5 years rigorous imprisonment with fine of Rs.1,000/- - in default whereof, he has been directed to undergo further one month simple imprisonment, he has already undergone 2 years 9 months and 26 days incarceration and earned remission for 6 months and 13 days as on 16.08.2016.

The petitioner shall furnish a personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the Jail Superintendent. He shall surrender at the end of the parole period.
