% 31.05.2017 Learned counsel appearing for the appellants seeks permission to withdraw the present appeal and states that he has advised the appellants to move an application for amendment of the plaint. 2.

Learned counsel for the appellants has submitted that the views expressed in the impugned order should not be treated as final and conclusive. We record that the impugned order states that the views are prima facie and not final and conclusive.

Lastly, it is submitted that the appellants would press for expeditious and early disposal of the suit. It is open to the appellants to make the said prayer before the single Judge.

In view of the statement made, the appeal is dismissed as withdrawn, without expressing any opinion on merits. If an application for amendment

of the plaint if filed by the appellants, it will be considered in accordance with law.
