% 02.03.2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 02nd July, 2015 passed in W.P.(C) No.8651/2014, whereby the respondent North MCD was directed to ensure that unauthorised construction/encroachment, if any, in Chandrawali, Civil Lines, Delhi after 01st June, 2014 is demolished/removed. The Court further directed removal of any encroachment on common areas/passages/streets and to ensure that no unauthorised and illegal encroachment takes place thereafter. Learned counsel for the petitioner states that the respondent nos.6 to 17 in the garb of a temple have been carrying out

construction on public land and streets of the village Chandrawali. Today Mr.Anil Grover, learned counsel for respondent nos.6 & 7, on instructions of respondent no.7, who is personally present in Court, and Mr.Mohd.Sajid, learned counsel for respondent no.8, on instructions of respondent no.8, who is personally present in Court, state that the order in question was not within the knowledge of the said respondents. They tender unqualified and unconditional apology on behalf of the said respondents for carrying out the said unauthorised construction. They further assure and undertake to this Court that no construction shall be carried out by the said respondents in future without taking prior approval from the North MCD as well as PWD.

The statements made by learned counsel for respondent nos.6 to 8 are accepted by this Court and the said respondents are held bound by the same.

In view of the aforesaid, present contempt petition is closed. MANMOHAN, J MARCH 02, 2017 KA
