Counsel for the appellant, after arguments, took a pass over so as to take instructions whether this appeal has to be pressed on merits or the appellant only wants time to vacate the suit premises. Learned counsel for the appellant has taken instructions and he states that appeal be disposed of RSA No.230/2016

as not pressed but the appellant be granted time till 31.3.2017 to vacate the suit premises.

Accordingly, subject to the appellant filing an affidavit by way of undertaking in this Court within two weeks to vacate the suit premises on or before 31.3.2017 and continuing to pay electricity charges, water charges and charges for use and occupation as decreed by the courts below, and on complying with the affidavit of undertaking, appellant is granted time to vacate the suit premises on or before 31.3.2017. 4.

Appeal is accordingly disposed of as not pressed but in terms of aforesaid observations.
