% 12.02.2018 Though bailable warrant issued on the last date of hearing is unexecuted, yet Mr.Amit Prakash Gupta, Director of the defendantcompany is personally present in Court. Today Mr.Amit Prakash Gupta has handed over to learned counsel for the plaintiffs a demand draft bearing No.300735 dated 09th February, 2018 drawn on UCO Bank, Bhupalpura, Udaipur for a sum of Rs.1 lakh. He further offers to pay Rs.3 lakhs by the following two post-dated cheques in full and final settlement. Sr.No.

Rs.1,50,000/- Cheque bearing No.000187 dated 10th September, 2018 drawn on UCO Bank, Bhupalpura, Udaipur.
Learned counsel for the plaintiffs states that in the event the aforesaid cheques are good for payment, he would not press for any other relief against the defendant.
Learned counsel for the defendant, on instructions of Mr.Amit Prakash Gupta who is personally present in Court, assures and undertakes to this Court that the aforesaid cheques are good for payment and the same shall be honoured.
The statements made by learned counsel for the defendant are accepted by this Court and Mr.Amit Prakash Gupta is held bound by the same.
In the event any of the cheques is dishonoured, the plaintiffs shall not only be at liberty to file appropriate legal proceedings but also the contempt of court proceedings.
Registry is directed to prepare a decree sheet in the aforesaid terms.
Accordingly, present suit and pending applications stand disposed of.
