JUDGMENT

24.08.2016 SANJEEV SACHDEVA, J. (ORAL) 1.

The petitioner has filed the present petition seeking a mandamus thereby directing the respondents to re-admit the petitioners in respondent No.2 school. It is contended that the names of the petitioners were struck off from the rolls of respondent No.2 school on account of non-payment of fees.

Learned counsel for respondent No.2 school submits that the respondent school is willing to re-admit the petitioners subject to each of W.P.(C) No.7157/2016

the petitioners paying Rs.1,59,135/-. Copy of the letter dated 22.08.2016 has been produced. The same is taken on record. 3.

Learned counsel for the petitioners has produced in Court a pay order in sum of Rs.3,20,000/- as fees for both the petitioners as demanded by letter dated 22.08.2016. The pay order is handed over to counsel for the Respondent/School.

The father of the petitioners Mr.Manish Kumar is present. He makes a statement that henceforth, the fee shall be regularly paid and in case the fee is not paid the respondents would be at liberty to take appropriate steps in accordance with law. The statement of Mr.Manish Kumar, father of the petitioners is taken on record. 5.

In view of the above, the writ petition is disposed of directing the respondent No.2 school to re-admit the petitioners on payment of regular fee as stated in letter dated 22.08.2016. The petitioners shall report to the school for joining on 26.08.2016.
